On Libby: Republican inconsistency and the true tragedy

Posted: Monday, July 02, 2007 9:53 PM by Sam Go

Chris Matthews, who was taking the day off today, called into the 7 p.m. edition of Hardball to react to the breaking news of Pres. Bush commuting Scooter Libby's 2 1/2 year-prison sentence.

“I’m not surprised,” he told MSNBC’s David Shuster.

“I’ve been saying for weeks I thought the president would pardon him. I didn’t think he would do this ‘three quarters of the way’ pardon which would leave him with a fine to pay and being disbarred.”

For Matthews, Libby was “at the concourse of intelligence, at the concourse of case for war, and apparently also at the concourse of the leaking operation.”

“Libby is in trouble for being part of a team – part of a team whose purpose it was to sell the case for war and to perhaps make sure that someone who was out to debunk the case -- Ambassador Joseph Wilson --  wasn’t credible. So everything he’s been accused of and found guilty of were efforts that were very much a part of the administration’s political purpose.”

“The irony in this case is that the president said he would 'deal with anyone who leaked,' and now his way of dealing with Scooter Libby is to pardon him.”

“For him to say that the penalty is 'excessive' may well be true, but it was the same crime that President Bill Clinton was impeached for by a Republican House of Representatives and in which 50 U.S. senators, Republicans, voted to remove him from office. So Republicans as a party thought perjury and obstruction of justice were sufficient to remove a twice-elected president from office. And now the president is saying that 30 months in prison is an excessive penalty for the same exact crime. It’s inconsistent.”

Matthews considers the human aspects of all this. “He was President Bush's political ally, so I certainly understand that he sympathizes with Scooter Libby and his family. The human aspects of this are totally understandable. And it may well be that Libby has suffered enough already and will suffer in the future... you could argue that the punishment has been exacted without Libby going to prison.”

Matthews thinks this decision wasn’t exactly a proud moment for the White House. “If the president were proud of his decision (and that’s his decision and his right to make it), he would have held something at the Rose Garden.  He would have said it in person and not issued a statement on paper. He wouldn’t have done it on a 4th of July holiday period with everyone out of town. He would have done it with some flourish and some pride.”

But for the Hardball host, the misinformation on the case for war – and that legacy – lives on. “The 25 to 30 percent of the country who believe in the president’s performance are largely conservatives, and they believe in the war. It’s frightening that 40 percent still think that Iraq attacked us on 9/11. Twenty percent of the country still believes there were weapons of mass destruction discovered by our military forces when they went into Iraq."

"The misinformation in this country remains after all these years -- because of the propaganda before we went to war. The results are still in effect. We’re still under a misunderstanding of the nature of why we went to war. That’s the tragedy here.”

Chris Matthews will provide more analysis on 'Today' Tuesday.

Notwithstanding what Chris Mathews thinks, this is clearly the perfect action. Libby now can pursue an appeal of his conviction without worrying about going to prison, which is as it should be.
So 30 months in prison for perjury and obstruction of justice is "excessive"  but, according to the same five Supreme Court justices who installed Bush as president, 25 years to life in prison is not "excessive" for stealing golf clubs or CD's? (See Ewing v California)

Never has the American citizenry been subjected to such a dramatic double standard, and never has this great country endured such blatant corruption at the "highest" levels of government.

This whole fiasco is a travesty of justice and a slap in the face for the american people. Once again the rest of the world is laughing at us. How can Chris Matthews even suggest that 30 months is excessive when it is a standardized term of incarceration for the crime of perjury. If I had turned-out a CIA agentand then lied to a Grand Jury undoubtedly I would be in jail for far more than 30 months. This is a democracy with equal protection under the law? Give me a break! I want to learn the Canadian National Anthem.
Bush is a puppet, Cheney is the real power behind the throne.  No doubt, it WAS Cheney that prompted the pardon.

I'm disgusted with the administration, there all liars.
Hear Matthews:

“For him to say that the penalty is 'excessive' may well be true, but it was the same crime that President Bill Clinton was impeached for by a Republican House of Representatives and in which 50 U.S. senators, Republicans, voted to remove him from office. So Republicans as a party thought perjury and obstruction of justice were sufficient to remove a twice-elected president from office. And now the president is saying that 30 months in prison is an excessive penalty for the same exact crime. It’s inconsistent.”

Whatever, Matthews! The only inconsistency is the bias of the media. Did Clinton go to jail for perjury? Besides, the original case in the Libby trial was thrown out, wasn't it? Clinton was not found innocent of misusing his office to engage in sexual harassment of an intern. In addition, he lied under oath. He was impeached - which really meant nothing; he still spent his term in office. Libby's jail sentence is unwarranted when compared to Clinton's You folks just play politics with all this nonsense, and thereby weaken the society's faith in the entire system. Shame, shame!!!
So much for the age of acountability.  Should we just ask Congress to chuck the National Security Act now, or wait until the last few moths of Bush's presidency.  Maybe the events are part of some quid pro quo scheme, and since "Scooter" was a good little soldier and fell on his sword...he was duly rewarded[commuted] for it.  Why stop there, the Vice-President should just turn over his records in response to the Congressional subpoenas, it's not like anyone is going to have him held accountable for possible alleged wrongdoings is it?  I guess the 14th Amendment is on it's last legs now...you know the part about all persons being afforded equal protection of the laws?  What about the part of now one is above the law?  Well guess what...there seem to be people who are.  There is a line of dialogue from Orwell's "Animal Farm," it goes something like..."All Animals are Created Equal...but some are more EQUAL than others."  Congratulations Mr. President...you are well on your way to proving Orwell right.
I am sickened by the arrogance of the Bush administration personafied by the Cheney Smirk. I am also sickened by the people who have been so mislead by this Administration and believe that Iraq attacked us on 9/11 and the story of WMD. I also do not understand why Hardball has on a guest like Ann Coulter who is not credible, who is 100% pure spin, who would say anything to discredit Democrats. Hardball is a political show and the guests are imputed credibility by virtue of being a guest on a quality show.  Therefore, by having the likes of Ann Coulter on Hardball and other shows propogate the spin and the hate. I'm not for censorship, but being a guest on a show is a privilege and a responsibility as is hosting a show. Lies and hatred are just as harmful to our country as is the racism that got Don Imus kicked off the air.
Is Bush's commuting Libby any worse than what Clinton did in his term as far as pardon's etc?  Or for that matter previous presidents?  Let's get off the "Hate Bush" saga and have some constructive news for once.

I, do not agree with everything President Bush has done and will do, but this "Hate Bush" saga the news media has been on began before he was elected President.

No wonder we the people are fed up not only with the House and Senate--but the news media too.
CHRIS MATTHEWS  BE CORRECT IN REPORTING. BUSH DID NOT  PARDON LIBBY.  I DONT KNOW ANYONE WHO HAS BEEN PARDONED  STILL BE ON PROHIBITION AND PAY A FINE.
When I heard the news, I wanted to scream...my blood was boiling. I have had it with this President...he is nothing but a liar and a crook. He has no honor and dishonors every American that has lost his or her life to uphold the values of our country, in this  war and all wars in the past. I only hope that people will remember this and all the other slap in the face moves by this president and the republicans when they vote for president in 2008.
Paris Hilton was guilty of only 1 crime. She partied with the wrong set of friends.
If President Busch can commute "Scooter" Libby, then why didn't he do something for the boarder patrol agents? Sounds like a one way street to me. If I were sentenced in the same manner for the same crime, do you think I would be commuted?

No surprise here. It was a shameful act by a shameful President with little regard for anything  or anyone except those in his inner circle. The contempt he holds for the rule of law is obvious by his choice for Attorney General. The President shouldn't be worried about his legacy. The list of colossal disasters from Iraq to Katrina to Alberto Gonzales and the Plame-gate travesty will define this administration as the worst in US history.
Chris, Libby's commuted sentence is simply one more example of the incredible arrogance and elitism of Bush and his administration. Apparently they believe that laws are sometimes useful in subduing their enemies, advancing their agendas and controlling you and me but do not apply to them. I think they were worried about Libby turning over on Cheney regarding the leak. Besides, I suspect that Libby is a fellow bonesman.

One other thing I want to mention, Bush does not have a "right" to pardon or to commute a sentence. He has a "privilege" to do so conferred upon him by the office that we the People (not me) bestowed upon him. I think it is very important to keep our understandings of rights and privileges distinct.

I enjoy your comments. You do a great job.
Scooter was a fall guy from the start and not even busted for the actual crime that was committed (name leak). So now there is absolutely no justice to be had for a breach of national security? From THIS administration who has used NS as justification for so many civil liberty violations? What faith can we have in our system of law now? What precedent has been set for the future?
What a bunch of whiners.  Take a look at any list of Presidential pardons, people have been pardoned of much worse things than being a fall guy for a scandal.  Clinton pardoned hundreds of embezelers and drug dealers, like it or not it is the President's right to use that power, if you want to complain go to the supreme court and overturn United States v. Klein.
I just don't get it.  How can anyone still think this President is upholding "and justice for all"?
A big "Jethro back of the head thump" to whoever says this is fair and Clinton's was justified.  It is a good thing Scooter isn't poor.  No one in the presidency would care about him or his family then.
No surprise. Who amoung us really felt that Libby would spend any time in prison? Bush has made it a major point to always protect loyal "Bushy's." Accountability for mistakes made, no matter how devastating to our country, is a foreign concept to this administration.
The difference between this pardon and others is that this is the pardoning of a crime that directly and intentionally benefited the President who granted it, and on the most important scale. It is a case of corruption at its purest. Allow other pardons and we're just weak on crime; allow this one, and we have a blueprint for tyranny and the end of democracy and freedom in America. We also have a blueprint for making bad policy appear to be good, to the ultimate harm of American interests. This issue should go well beyond partisanship. It is the most fundamentally undemocratic and unethical thing this autocratic and morally bankrupt President has done. Anyone who would defend it has no idea what America was founded to be.

Impeach Cheney first.
Bush is a puppet, Cheney is the real power behind the throne.  No doubt, it WAS Cheney that prompted the pardon.

I'm disgusted with the administration, there all liars.
Bush's decision to commute Libby's sentence has made it clear that he has no respect for our legal system.  The Bush administration and all those in it are above the laws of the land. Republicans feel that only Democrats and illegal immigrants should be required to obey the laws.

What can we do? Either I abstain from voting because it is pointless or I vote only for those who have never held office before in an effort to start over clean. Republicans AND Democrats should think about this.
Why is anyone surprised?  And, if we compare poor Scooter's crime to all the other crimes committed by this administration, the punishment for his is indeed relatively very severe.   Dick Cheney thinks that he is above the law - and he always has - I repeat, why is anyone surprised?
I wonder if Bush will wind up pardoning Cheney before his term is over?
As a member of the military I think we should send this whole bunch of administration criminals to the Hague.  Commander in thief is more like it!  The only people in this country happy about Scooter are Neo-cons who dont have a clue about laws, actually fighting in a war, or what the hell is going on period!!!
Funny, we all screemed when Paris got special treatment. she actually spent some time in jail but not Cheney's front man. America is not the country I grew up in and I fear for my grandchildren
The commutation settles it for me: Between too-cute-by-half and threading-a-fine-needle, Bush is by far the worst President in American history. The next 18 months will see two hurricane seasons. With "friends" like this corrupt bunch, maybe I better hope I have some REAL friends out there. On the other hand, maybe taking matters into my own hands (new shutters to replace the half-inch plywood I had been using) is exactly the thing this bunch of self-serving twits want me to do. They say Hell with folks like me, I say may they rot in Hell for all I care.
Nothing coming out of this administration surprises me. I'm long past gasping in shock or sending letters of indignation to congressmen. As an American working for the past ten years in the Middle East, I have traveled an emotional rollercoaster between feeling incredible pride in our system and utter shame by acts such as this. Make no mistake - this administration has caused catastrophic damage to our standing in the world. We are no longer considered a just country - and no wonder - look at what we've wrought at home and abroad.
I am very angry that our President is covering up the wrong-doings of Vice President Cheney and himself by taking away the prison term given to Mr. Libby for obstructing justice and lying to a grand jury.  God pray for our country and save the USA from the WRONGFUL USE OF POWER demonstrated by the President & his cohorts. It is a sad day when the abuse of power continues and continues throughout President Bush's term and people in the news find ways to say it is OK.
Wake up America! Blink, yawn and stre-e-e-e-t-t-ch. Look around and see "why" this country and it's "new" form of constitutional government came about. These are the challenges and fears the founders wrestled with in their discourse. Now, deep breath. Feel the uncertainty about the future. Is this really happening? Feels like Germany-- early 1930's. Scared? What to do? Educate yourself about how our government is structured. Read the basics. Learn (about the people's nation of laws). Apply it. Let it work. Understand truth and the consequence of perjury. Now relax and elect honest, truthful and vigilant representatives. Tell them: "Do right."--simply--"Do right" ... or "be gone."                                                    Learn more about your government and proudly watch it work. Do not let anyone change your government. It is worth fighting for then and now.
The White House was scared too death of Libby turning on them and they had to do something.
I think Chris, you hit the nail on the head when you said he wasn't proud of his decision.  I think this eats at his ego of being tough on crime.  Lord knows when he mocked that lady on death row begging for her life he had pretty much put a polish on his tough guy image.  I don't think he wanted to do this and I think it chaps his a** that he was forced to.
I have said all along Libby would not spend one day in jail. By commuting the prison time, GW has in effect Obstructed Justice, not in a legal manner, as Libby was convicted of by a jury. The thought and belief of equal justice for all has been shot down in flames.
It is a reality of this great country that we live in that all men are not created equal...race, sex, socio-economic realities influence decisions and  outcomes within our courts, educational, and corporate systems.

What can we do as Americans to protect our great country now that there have been decisions that have been foisted upon us that the many of us do not agree with?

How can we as indivuiduals and collectively influence a positive resolution to the Iraq war and the multitude of decisions that have been made by the President, his staff. and Congress?

How do we stand together as a nation to point our country in the right direction? What role has the media played in dissemintaing information that is oftentimes misleading and inaccurate?

When all is said and done countries that look at our political decisions care not whether they were made by a democrat or a republican...

I do not agree with the Presidents decision but I pray for him his staff and Congress ... Can the many mistakes of this administration  be corrected and how long will it take to point us in the right direction   May God bless our country, our people and our political leaders...
It's expected from this Administration;with absolute power, those who wield it are corrupted absolutely. I expected no less from President Bush and his cronies. Just to be clear I don't hate Bush. I dislike his policies and his manner of governance. I'm sure in his mind he justifies his actions, however, those actions cannot be rationalized with the facts. Further, without a truly informed citzenry, and motivated legislature, I doubt he will be held to account, at least during his time as president. As Americans we have had dark times in the administration of our country's affairs, and we will have them again. Just a few more months to go, and this abuse of our republic will be over.
Bush and his cronies are all about their narrow, imperialistic, conservative agenda AT WHATEVER COST. Be it 2 billion dollars a week, or lives or lies. Be it twisting laws or issuing signing statements to twist the constitution. But you know a country gets the leader it deserves. The democrats have never been sure how to counter this madness and the american people have allowed it. So whats a calculating crook like Cheney to do, but take full advantage. America has slid and the whole world has seen this decline. Shame shame!
I guess by the your logic Chris, the next round of get out of jail free cards should go to the legitimate Mafia, the Crips & Bloods and any assortment of other "team players".
And the lesson for for the general public is: Don't bother ever reporting a federal crime, or cooperating with the FBI in their investigation of a federal crime. And, don't waste your time with jury duty.
By granting commutation against Justice Department guidelines that prohibit doing so before the appeals process has concluded, President Bush's action raises new questions. What if Scooter Libby's ongoing appeal of his conviction is ultimately granted and a new trial is ordered? If found guilty a second time, could he be re-sentenced to prison?
It's useless to even be talking here any longer. By this point, those who haven't turned away from this administration never will. Bush and Cheney would have be caught having gay sex on the White House lawn for their approval to go any lower.
Everybody remember that Scooter Libby was not the leaker. Ex-Clinton Cabinet member Richard Armitage was the leaker.  Fitzgerald knew this information before he started his investigation of Scooter Libby.  Bush did the right thing.  Thank God!
what is really sad is what Chris said about the general misconceptions regarding the war by so many americans....how dumb are we that we are so easily mislead?
'We’re still under a misunderstanding of the nature of why we went to war. That’s the tragedy here.”'

Try reading the Congressional authorization to use military force against Iraq, then you'll understand the reasons we've been fighting in Iraq.

And, the only tragedy here is is that the Wilsons haven't been charged with espionage and treason.
This just another example of how George W. Bush and his cronies think they are above the law. Using what
ever methods they want to accomplish their agenda, which is obvouisly not in line with wishes nor the best interest of the people of the United States, but
more in line with their own interest and those of their supporters.
Treason, conspiracy to commit treason, and aiding and abetting acts of treason by the commission of perjury.

Only logical that the ringleader would pardon his gang members.
here we go i guess the law don't apply to the  rich just to the poor.
It looks like Bush has drilled another hole in the bottom of the sinking ship of approval ratings.  I wonder what else he has done that we DON'T know about?
Boy I wonder if Sandy Berger, Congressperson Wiliam Jefferson, Harry Reid, John Murtha and the Terrorist pardoned by Slick Willie are upset with???? hhhmmm. We all know democrat party activist Chris Matthews is!
Five will get you ten Libby would have sung like a canary had he ever seen the inside of a jail.  Now that bird will hold his tongue.  There's the real story of the commutation.
What is happening to our country? This is an outrage.

At this point, the American people do not have a president anymore.  Only a select few radical elitists bent on greed and corruption via secrecy, lies, dishonor, and cultural imperialism have a president.

This administration has continued to lie and patronize the American people consistently over the years.  They have used propaganda to play off of people's insecurities to further their corrupt cause, which is exactly what happened in Germany in the 1930's.

Yet this just shows that none of them can be held accountable - they feel they are now above the law of this country.  Bush has made a mockery of our justice sysem from illegal wire taps shrouded behind the exploited Patriot Act to now all but pardoning the one person in his inner circle who was actually held accountable by the American People.

Based upon precedence, this is absolutely the worst presidency in the history of the United States.  And all the die-hard conservatives want to do is blame the media...hah! I guess they feel unless the information comes from Fox News, then it CAN'T be true.
July 4th coming up. Forget the red white and blue. Our American flag according to our government should be green and white with dollar signs for the stars.  What has happened to us as people. A shame.
Facts are Facts.  Bush has pardoned 113, including several drug dealers, embezzlers and a bomber.  Those who continuously cite Clinton's record need a reality check about this Administration - the Bush boys "ain't" no angels.

Bush's abuse of his Executive Power scares the daylights out of me.  The Libby thing, however, is minor in comparison to his other atrocious decisions.

Those who are talking about the "flagrant" abuse and violation of the law with regard to this act should read their Constitution.  The action is completely legal, and many Presidents (see Clinton/Mark Rich and others) have used it (if not all).  Agree or disagree with the commutation of the sentence, but you just sound foolish with the ignorance displayed when you dont know the "constitution" you so bitterly complain about Bush destroying.
